• Battelle defrauded
patent office and Technical Assistance Program that funded developing Mobile
Data Manager
[MDM] software for
Pulver’s small business.
▪ On 8/29/03, it delivered non-working version and withheld working MDM software from
him who had worldwide exclusive license to market
& develop follow-on
versions.
Meanwhile, Battelle was illegally marketing
working version
to Ecolabs [Fortune 500] to license MDM as point-of-sale catalog for worldwide sales force. [Undercutting Pulver]
▪ It nominated working MDM version for R&D 100 Award, adapted to BlackBerry, suddenly called "new
code” [saying “so Pulver is toast”], wrote ‘NEW’ invention report [“RDADS”],
reset/evaded prior statutory filing deadlines & fraudulently applied for patent, and [admittedly] commercialized.→ 2 sets of MDM versions thus exist: Working & Non-Working.
▪ Battelle implicates itself: Admitting it developed working versions 3 months before delivery, it asserts right to deliver unworkable version [“zero...less than a Barbie Doll”].
Calling that
“ridiculous” and based on extensive evidence, judge denied
Battelle’s
2008 motion to dismiss Pulver’s breach of contract claim [withholding working versions].
• Battelle documents, testimony & filings show perjury [Falsifying

Ventures] by developer Dorow to conceal patent fraud [falsifying inventions] & false claims.

2004-05, Dept.
of Homeland
Security Radiation Portal Monitor Project [RPMP] funded Battelle to adapt MDM to BlackBerry
for installers
of monitors
at US
ports/borders.
▪ To hide evidence the actual MDM software worked, was enhanced [BlackBerry] and patented, Dorow & DOE-funded counsel misrepresenting
DHS research to the court.
▪ Battelle admits misrepresenting inventions to USPTO, e.g., its 2005 patent application for RDADS
that’s actually the 2002 MDM inventions [with expired 2003 filing deadlines].
▪ Battelle falsely
denied funding development of commercial RDADS-RFID version [for Cargo Security], wireless technology in which Battelle Ventures invested $15.5 Million.
